Of the 3,500 people currently dying each year of asbestos related diseases, 25% have once worked in the building and maintenance trades and often would have worked unknowingly on, or near to, asbestos containing materials (ACMs). The requirements of the duty to manage seek to prevent further unknowing exposure to asbestos by building and maintenance workers. The duty holder is responsible for the safe management of asbestos containing material within such premises. In order to enable him to manage the risk from the asbestos, the duty holder shall ensure that a suitable and sufficient assessment is carried out as to whether asbestos is or is liable to be present in the premises. The duty holder's responsiblities: The duty to manage requires those in control of premises to: Take reasonable steps to determine the location and condition of materials likely to contain asbestos Presume materials contain asbestos unless there is strong evidence that they do not Make and keep an up-to-date record of the location and condition of the ACMs or presumed ACMs in the premises Assess the risk of the likelihood of anyone being exposed to fibres from these materials Prepare a plan setting out how the risks form the materials are to be managed Take the necessary steps to put the plan into action Review and monitor the plan periodically Provide information on the location and condition of the materials to anyone who is liable to work on or disturb them Complying with these regulations means the completion of an asbestos survey. By carrying out an asbestos survey, a risk assessment can then be produced providing the first part of the management plan and working towards the prevention or reduction of exposure to asbestos. It places duties on an employer, including self-employed, who carry out, &lsquo;any work which exposes or is liable to expose any of his employee to asbestos&hellip;&rsquo; to protect all employees and anyone else who may be affected by the work. There is also a specific duty under CAWR to manage asbestos in buildings to ensure that asbestos is kept in good condition and to prevent uncontrolled work or releases. What will Duty to Manage mean to you? The requirements of the Regulation 4 of the Control of Asbestos at Work Regulations 2002 seek to prevent further unknowing exposure to asbestos of building and maintenance workers with the aim of saving 5000 lives over the next 50 years. The HSE has recognised the risk of exposure to asbestos and since 21st May 2004 has made it a legal duty to assess and manage the risk of asbestos in buildings.  It is essential to know the location and condition of asbestos within buildings, to maintain written records, to document actions and to have a management system and procedures in place to avoid exposure to asbestos fibres. The new regulation covers all non-domestic premises, whatever type of business is carried out in them. It also covers the common areas of domestic premises, including halls, stairwells, lift shafts, roof spaces and external areas. Who will be the dutyholder? All those who have responsibility for the maintenance and or/repair of non-domestic premises have duties under this regulation. The extent of the legal duty is determined by the terms of any tenancy agreement or contract that applies, and in the absence of any such agreement, on the degree of control the party has over premises. The dutyholder may well be the landlord, tenant or a managing agent, depending on the circumstances of the case. In some situations, responsibility could be shared between two or more parties. The regulation also includes a duty to co-operate, which applies widely. This will, for example, require a tenant to allow a landlord to gain access to a building to carry out a survey. Also a building surveyor or architect who had plans which show information on the whereabouts of asbestos would be expected to make theses available to the dutyholder at a reasonable cost. What should the dutyholder be doing immediately? Check that the current arrangements for the management of asbestos within their premises are effective and are being applied properly; Adopt a precautionary approach to maintenance work. Until a proper assessment of their premises has been carried out, they must assume that all materials being worked on are asbestos, adopting the standards set out in &lsquo;Asbestos essentials&rsquo;; and carry out an initial inspection of the premises to look for serious damage and disturbance and take effective remedial action as necessary. What should dutyholders do next? Plan their compliance strategy. It is being introduced to consolidate and simplify the existing legislation. Fire certificates will be replaced by a risk-based assessment, whereby accountability lies solely and firmly with the &ldquo;responsible person&rdquo; in any business. It will no longer be the Fire Service&rsquo;s duty to make sure the workplace is safe. That duty will lie with the &ldquo;responsible person&rdquo;, who will be held accountable under the new legislation. Employers currently have many responsibilities to comply with the law relating to fire safety of property and employees. However, responsibility for fire safety in non-domestic premises (including empty business premises) will rest solely with the designated &ldquo;responsible person&rdquo;. Employers have an obligation to carry out and have in place their own fire risk assessments, or employ a competent person to carry them out on their behalf. Legionnaires&rsquo; disease is a potentially fatal pneumonia caused by legionella bacteria. Infection is caused by breathing in small droplets of water contaminated by the bacteria. The disease cannot be passed from one person to another. Everyone is potentially susceptible to infection. Where is legionella found? Legionella bacteria are common in natural water courses such as rivers and ponds. Since legionella are widespread in the environment, they can contaminate and grow in other water systems such as cooling towers and hot and cold water services. They survive low temperatures and thrive at temperatures between 20&deg;c - 45&deg;c if the conditions are right, e.g. if a supply nutrients is present such as rust, sludge, algae and other bacteria. What are my duties under the law? Under health and safety legislation and the L8 Approved Code of Practice, you have to consider the risks from legionella that may affect your staff or members of the public and take suitable precautions. As an employer or a person in control of premises (e.g. landlord) you must: Identify and assess sources of risk Prepare a scheme (or course of action) for preventing or controlling the risk Implement and manage the scheme appointing a person to be managerially responsible (known as the &ldquo;responsible person&rdquo;) Keep records and check that what has been done is effective As the employer or person in control of the premises the risk assessment is your responsibility. The damage to hearing is slow, painless and permanent. If you have to raise your voice to be heard by someone about 2 meters away, the noise level is probably excessive and a risk assessment should be undertaken by a competent person. Our consultants are able to carry out the noise risk assessment and can identify practical solutions to your problems. The Control of Noise at Work Regulations 2005 The new Control of Noise at Work Regulations 2005 came into force on 6th April 2006, replacing the Noise at Work Regulations 1989 and introducing lower noise exposure action limits and values. The aim of the new regulations is to ensure that workers are protected from excessive noise levels by controlling exposure The existing action levels were both be reduced by 5dB(A) and replaced by action values of 80dB(A) and 85dB(A) respectively. Lower Exposure Action Value: Employers must provide information and training, and undertake a risk assessment where a daily or weekly employee exposure of 80dB(A) is exceeded. Upper Exposure Action Value: Hearing protection must be provided and hearing protection zones identified when workers exceed a daily or weekly exposure of 85dB(A). Exposure Limit Value: There is also a limit of 87dB(A) above which workers must not be exposed. This takes account of any reduction in exposure due to the provision of hearing protection Noise Risk Assessment Noise induced hearing loss can be caused by either a sustained exposure to excessive noise levels or high impulses of noise, which can cause instant damage. Therefore, measurements are taken which assess the average &lsquo;noise dose&rsquo; an individual is subjected to throughout the day and also any &lsquo;peaks&rsquo; of noise which could result in instant hearing damage. Noise levels measurements are undertaken using an integrating data logging sound level meter or dosemeter worn by an employee for the duration of the working shift. Noise levels are recorded over a period of time in order to assess the personal noise dosage levels. Measurements are included in a report to the client in graphical form, along with recommendations for noise exposure control. Although 220 workers were killed in the past year and 363,000 seriously injured, up to 2 million people are currently suffering from work-related illness with 576,000 of these reported in the last 12 months. Using chemicals or other hazardous substances at work can put people&rsquo;s health at risk. Legislation, such as the Control of Substances Hazardous to Health Regulations 2002 (COSHH) requires employers to control exposure to hazardous substances to prevent ill health. They must ensure that both employees and others who may be affected by their activities are safe and their exposure controlled. If you, as an employer, fail to adequately control hazardous substances, your employees could be affected. Effects from hazardous substance exposure can range from mild eye irritation to chronic lung disease or even, in the worst case scenario, a fatality. Internal pollution can be caused by such factors as construction materials used in the building, furnishings, fixtures, equipment and materials in use and even the land where the building is sited.  As an employer you have a duty under the Health and Safety at Work Act 1974 to ensure the safety and wellbeing of your employees who work in an indoor environment. The Control of Substances Hazardous to Health (COSHH) Regulations 2002 requires employers to assess and control the exposure of their workforce to hazardous materials.  The Workplace (Health Safety and Welfare) Regulations 1992 also require that a &lsquo;sufficient supply of fresh or purified air&rsquo; is provided. Building Related Sickness (Sick building syndrome) Poor air quality can reduce productivity and increase sickness absence. The symptoms of building-related sickness can include: Irritation of eyes, nose and skin Headache Tiredness or lethargy Flu-like symptoms Breathing difficulties How ALS can help Our consultants have the necessary expertise and equipment to undertake a thorough building survey, detecting airborne contaminants including, carbon monoxide and carbon dioxide, volatile organic compounds, and many more airborne contaminants including substances as diverse as mercury and lead. The majority of our equipment is direct reading and will provide instant results. Other environmental factors such as temperature, noise, relative humidity, lighting levels and ventilation rates are also measured. Clients are then advised on the measures necessary to maintain a healthy and productive workplace. LEV Testing Where a local exhaust ventilation system such as dust or fume extraction is used to control exposure to substances hazardous to health, there is a legal duty to ensure that the system continues to operate effectively. Thorough examination and tests should be carried out at least once every 14 months to ensure the LEV equipment remains in good working order and comply with the COSHH Regulations 2002. Its uses include medical and industrial instruments such as thermometers, manometers and pressure sensing devices and it is still used in the electrical industry for the manufacture of fluorescent and mercury discharge lamps. It has also been widely used over a number of years in educational establishments, including schools, colleges and universities and is still in use even today in research laboratories and Hospitals. Exposure to mercury can occur from direct skin contact, although the principal route of exposure is by inhalation.  Symptoms from exposure can range from nausea, vomiting, and abdominal pain to kidney damage and in the worst case scenario, death. The Control of Substances Hazardous to Health Regulations 2002 (COSHH) requires employers to protect people in the workplace against the risks of exposure to substances classified as hazardous to health. The employer&rsquo;s duties are: To identify the hazards and assess the risks created by work with hazardous substances. To monitor the level(s) of exposure To devise and implement measures aimed to prevent employees coming into contact with hazardous substances or control exposure. To ensure control measures implemented are maintained, assessed and tested to ensure effectiveness. To provide health surveillance for certain hazardous substances To provide information, instruction and training to employees who may be exposed to hazardous substances. If equipment containing mercury is being used on your premises, or has been used in the past, there is a possibility that mercury contamination is present.  The only way to be certain is to carry out a mercury survey.
